First, what is a class action?
A class action is a lawsuit filed by an individual plaintiff or small group acting on behalf of a large group with similar claims. Normally, notices are sent to those individuals who are potential members of the class. Potential class members are given the opportunity to opt-out but otherwise are automatically part of the lawsuit.
Why are we not filing your case as a class action?
The law in Texas has changed significantly over the last decade and it is extremely difficult to obtain class approval by a Judge.
In a class action lawsuit, members potentially give up any control over their claim. Once named plaintiffs accept a settlement, it is typically binding for all class members.

This is your lawsuit. You will have control of accepting/rejecting any potential settlement offers. We will work tirelessly to resolve your claim successfully.
What does this mean if you do not file a royalty claim?
Those who do not file a lawsuit will not receive any payments from successful settlements or judgments we produce for our clients. Therefore, if we are successful in representing your neighbor, you will not receive compensation because your neighbor’s lawsuit was successful. This is not a class action.
